There should be no legal issues, they stole it from you, you should have full rights to the location of YOUR property. Hell, you should have the rights to track the thief down with a baseball bat.
So let's say the person who has it purchased it used at a pawn shop (or anywhere), so the person that we are invading their privacy and knocking on their door with a baseball bat would sue Microsoft.
When it comes to the whole idea of having it so the Zune is "locked out" when the thief tries to use it, they will just throw it away, so I really don't see what good that will do. If the police knocks on their door one day and start to ask questions they will say they don't know what they are talking about, and being that the Zune is not around there would be no proof.
The only good I can see is for the future, like everyone in this thread is saying, is if it is known the zune to brick upon being stolen there will be less zunes getting stolen. Seriously tho, are thiefs gonna be "up to date" and be aware of this situation? Most likely not.
