To change this requires people very high in Zune and Microsoft talking with the labels to get permission to allow it for specific reasons. Any downloading error can be caused by the ineternet, the Zune Client, the customers PC and many other reasons. Bad content is another issue that gets effected by this as well. You buy an album but the MP3 audio is for a completely different artist, or skips. All of these are the reasons we are pushing for a change to this, but it takes time. Even for testing I have to have multiple accounts to verify if an MP3 is fixed or not. I know it is frustrating, but we are working to get some resolution to this.

You didn't read this did you. This clearly states what while it is not entirely a Label Issue and it is not entirely a Zune Software issue the very real possibility is that it is in FACT a label issue. There is even a user in this very thread claiming he had this very thing happen to him on 3 different album purchases from the exact same RECORD LABEL. The obviousness of the problem should be plain to see (that MOST of the problem is in FACT label related and NOT Zune Marketplace Related).
Hold your breath someone is about to tell the greatest lie EVER!

Policy does not say you cannot redownload mp3s (I have done it several times). There are issues with recording labels that MS is trying to fix and because of the Record Labels restriction do not allow this.

MP3 tracks that are purchased from Zune Marketplace are not eligible for redownload, repurchase, or restore.

As a bit of Fuel here...
I picked up an album on Zune Pass ( Pirates Of The Caribbean: Original Score ), decided I liked it, then bought it prior to the release of the MP3 version, so I have the WMA version on disk. I noticed that it had stopped Syncing with my Zune, upon investigation of why that was, I noticed that it was throwing a C00D12EA error. When I went to play it from my Collection ( its physically on the disk ) received the C00D12EA error. Figuring something was up I looked up trying to restore it, once again the C00D12EA error. At which point I noticed that there was an MP3 version of the disc now available.
This scenario is not a direct Download issue.. it’s a right to play/sync a WMA issue where the purchase venue has changed from WMA to MP3 Iv never had the MP3 version of the disc.
Update:
Actually.. I’m looking at all the errors I’m having with Sync’s to my Zune, and they are all the same situation.. A purchased WMA version of something available now as an MP3..
any ideas?
There is some odd coding on the marketplace in some instances. From what I read about what you're describing, sounds like that album got caught in the sudden unspecified record label change that effected more then a few things to cause a massive headache (don't remember where Ir read it). Basically the record label changed a bunch of files and didn't inform MS or they weren't implimented properly and it just screwed a bunch of crap up. Which they are trying to clean up now and it's just one really big hassle. if you have the songs on disc though they should play and you can even rip them back as mp3s if you wanted. As always though mp3 trumps any wma i.e. if you had an mp3 version of a song, say you purchased it and lost it. You cannot download the wma version for play (if that makes any sense).
That’s the thing… they are not MP3’s they are WMA’sThe marketplace is not letting me play, sync, burn or redownload them, Even though it shows them in my purchase history.

If they are mp3s you are out of luck as you can't redownload mp3s as another user and zune team member have stated.
